TRANSPARENCY & RESPONSIBILITY

Terms of Service

A clear explanation of the platform, merchant responsibilities and the arrangements that govern the service.

Review draft

Operator identity/address, governing law and production data-handling arrangements still need final confirmation. These pages are not a replacement for an executed merchant agreement.

1. Operator, scope and agreements

Emerald Gift Cards is operated by Anchorflow Studios. These terms describe permitted website use and the proposed baseline for the merchant service. They are provided as a review draft and become service terms only when adopted through the applicable contracting process.

A signed merchant agreement and order form identify the contracting parties, business addresses, service scope, fees, term and any specific service commitments. They take precedence over these website terms where they differ. Browsing this website, sending an enquiry or creating a pending account does not itself finalise a paid service order.

2. Merchant-issued gift cards

The issuing merchant sells and issues its own gift cards and is responsible for accepting payment, honouring valid cards, handling customer support and complying with its obligations to cardholders. Cards are redeemable with the issuing merchant under that card’s displayed terms and location rules; they are not a general-purpose balance across unrelated businesses.

Anchorflow Studios supplies the software, card records, delivery tools and operating controls. Customer payment is collected through the merchant’s own arrangements. The platform does not collect, pool, safeguard or settle gift-card sale proceeds. It does not independently verify a merchant’s cash receipt, bank statement or payment-terminal result when staff record payment confirmation.

3. Business accounts and authorised users

You must have authority to act for the business whose account you create or manage. Business access is subject to approval and the applicable service agreement. Owners must keep business details current, authorise appropriate staff access, protect credentials and promptly remove access when it is no longer needed.

Do not share accounts, bypass permissions or let another person use private access links without authority. Report suspected account misuse to [email protected]. We may restrict access to protect users, investigate misuse, comply with law or enforce agreed billing obligations.

4. Payment confirmation and card operations

Authorised staff must confirm that the merchant has received the appropriate payment before issuing a card, except where an expressly authorised waiver or other arrangement applies. Enter the correct amount, currency, location and reference. A platform entry records the instruction; it is not a new charge to the purchaser’s payment card.

Merchants are responsible for the accuracy and authority of their instructions and for reconciling platform records with their payment records. Refunds, voids and adjustments in the platform record gift-card activity; they do not themselves send money back through a bank or payment provider. The merchant must complete any required external refund separately.

Card expiry, permitted uses, location restrictions and refund policies must be clearly disclosed by the merchant and applied consistently with applicable consumer law. These platform terms do not replace a card’s terms or remove a purchaser’s mandatory rights.

5. Email, scheduling and shared links

A card may be emailed to a recipient, sent to the buyer for later gifting, or printed/shared after issuance. Where enabled, a buyer or authorised user may choose a recipient and schedule a future send. Check the email address, date and time zone before confirming. Editing or cancellation may no longer be available once dispatch has been claimed or completed.

Scheduled sending is a requested dispatch time, not a guaranteed inbox-arrival time. Email systems, spam filtering, connectivity and service interruptions may affect delivery. “Sent” indicates the sending system accepted the message; it does not prove the intended person opened it. An unconfirmed outcome may already have delivered, so check before requesting another copy.

Protect redemption and buyer-management links. Forwarding or sharing a link can give another person access to the card or its delivery controls. Contact the issuing merchant about a lost, misdirected or compromised gift.

6. Plans, usage charges and payment

Website prices are reference prices in Trinidad and Tobago dollars, not a binding quotation. The approved order form sets the subscription, included allowances, any add-ons, taxes, payment method, due dates and notice requirements. Additional development, integrations and service commitments are included only if expressly agreed.

Subscription and recurring add-on fees cover the invoice’s billing period. Completed-month issued-value overages are billed afterwards. The allowance measures the face value of cards issued in the relevant calendar month, not the number of cards or the amount redeemed. An overage rate applies to issued value above the included allowance, rather than to all card sales.

The current monthly billing windows use America/Port_of_Spain time. Monthly volume terms are fixed when that billing month opens; changes then apply to future opened periods. Charges already billed for a usage month are accounted for when it is settled. Cancelling the service does not cancel charges already incurred, including a final completed-month overage.

Payment collection and overdue handling follow the agreed merchant arrangement. This website does not promise a free trial, automatic refund, price lock or cancellation notice period that has not been agreed in writing.

7. Acceptable use and customer content

Use the service only for legitimate merchant gift-card activity. Do not submit false payment confirmations, attempt unauthorised redemptions, send spam or unlawful messages, introduce malicious code, access another business’s data, circumvent usage or security controls, or resell platform access without permission.

You must have the right to use uploaded branding and the authority to provide recipient details and messages. Do not upload payment-card credentials or sensitive personal information into messages or free-text notes. The Privacy Policy explains how the service handles information and requests.

8. Data, confidentiality and intellectual property

Merchants retain their rights in business data, branding and content. They authorise the processing reasonably needed to provide, secure and support the agreed service. Data-processing instructions, provider arrangements, hosting locations, confidentiality obligations and retention requirements should be set out in the merchant agreement or its data-processing addendum.

Anchorflow Studios and its licensors retain rights in the platform and website. Your service subscription permits authorised use; it does not transfer ownership of the software or permit copying, distribution or reverse engineering except where applicable law provides otherwise.

Private account data and gift links must not be disclosed without authority. Operational reports help a merchant reconcile activity; they do not replace the merchant’s accounting, tax or legal responsibilities.

9. Service availability and responsibility

We aim to operate the agreed service with reasonable care. Unless a signed agreement states a specific service level, no uninterrupted-availability target, exact delivery time or recovery-time guarantee is offered by this website. Planned maintenance, security work and third-party failures may affect service.

Responsibility for loss is assessed under the applicable agreement and law. Merchants remain responsible for their payment arrangements, instructions, staff permissions and cardholder obligations; the provider remains responsible for its own agreed platform obligations. Any negotiated liability caps, exclusions or indemnities belong in the executed merchant agreement. Nothing here excludes a duty or remedy that cannot lawfully be excluded.

10. Suspension, cancellation and outstanding cards

The service term, renewal, cancellation notice and any cure period are set in the merchant agreement. Access may be restricted where reasonably necessary for security, legal compliance, serious misuse or an agreed non-payment process.

Before ending service, the merchant must arrange for outstanding gift cards, customer communications and any required data export or transition. Ending platform access does not erase cardholder claims or the merchant’s liability for its cards. Export scope, assistance charges, access during transition, deletion and legal-retention exceptions must be agreed; instant self-service account deletion is not promised.

11. Governing law, disputes and changes

The existing merchant-agreement template proposes the laws and courts of Trinidad and Tobago. This selection remains subject to operator confirmation and the executed agreement. Nothing here overrides mandatory laws or consumer rights that apply to a purchaser.

Raise service concerns with Anchorflow Studios first; raise gift-card purchase, redemption or refund concerns with the issuing merchant. Changes to these pages will carry an updated review date. Changes to an active merchant contract follow its own notice and acceptance process and do not silently rewrite a signed agreement.

12. Contact

Contact [email protected] or visit anchorflowstudios.com. Include your business name and a non-sensitive reference. Do not email passwords, full payment-card details or private redemption/management links.
